This Indenture made on this Eight
day of Feby. in the year of Christ one thousand Seven Hundred and seventy five
between Micajah Bullock of the County of Granville & Province of N. Carolina
of the one part and McCall Elliot & Co. Merchts. of the other part.
Witnesseth, that for and in Consideration of the sum of Fifty Eight pounds three
Shillings & four pence Virga. Money which he the said Micajah Bullock is
Justly Indebted to the said McCall Elliot & Co. and honestly to secure and
pay to them and for and in farther Consideration of the sum of five Shillings
lie money, to the said Micajah Bullock in Hand paid by the said McCall Elliott
& Co. at and before the sealing and Delivery of this, the Receipt whereof I
do hereby acknowledge, and thereof, and of every part thereof do exonerate and
discharge the said McCall Elliot & Co. their Heirs, Executors, and
Administrators, he the said Micajah Bullock hath Granted, Bargained, sold and
Confirmed, and by these presents doth grant, bargain, sell, and Confirm to the
said McCall Elliot & Co. their Heirs and assigns forever, One Negro Wench
named Rose & also one mans Stall, with all the appurtenances belonging, or
in any wise appurtaining, to the premises hereby Granted, or intended to be
granted and the Reversion and Reversions, Remainder and Remainders and all
Services, benefits, and Profits of the said negro Wench and premises, and all
his Rights, Claim, Interests, and Securities relating to the same.
To have and to hold ... upon Trust, nevertheless, that the said McCall Elliot
& Co. their Heirs, Executors, Administrators, or assigns, shall (after the
Twenty fifth Day of December in the year of Christ one thousand seven hundred
and seventy five, as soon as the said McCall Elliot & Co. their Heirs,
Executors, Administrators, or assigns, shall then prefer, or the said Micajah
Bullock Shall Request them (which ever of these two Sircumstances Shall first
happen) Sell for the best price that can be gotten, after giving ten Days Ten
days publick Notice the said Negro Wench and premises and out of the money
arising from such sale discharge, pay, and satisfy the above mentioned sum of
Fifty Eight pounds three Shillings & four pence Current Money with Lawful
Interest from the Eighth day of February one thousand Seven Hundred and Seventy
five until the same shall be fully discharged and the Expences attending the
drawing and Recording this Indenture, and the Contingent Charges of Sale, as
aforesaid, and other necessary expences that shall attend the Securing and
obtaining the above mentioned Money or performing any Thing that is or shall be
nesecessary relative to the Interest of the Indenture, and that the said McCall
Elliot & Co. their Heirs, Executors, Administrators, or assigns shall pay,
or cause to be paid, the overplus, if any remain from such sale, to the said
Micajah Bullock his Heirs, Executors, Administrators, or to his order. In
Witness whereof the said Micajah Bullock hath hereunto set his hand, and Seal,
on the day and year first above Written.
