Indenture 29 Aug 1825
This Indenture made this twenty
ninth day of August in the year of our Lord one thousand eight hundred and
twenty five Between Benjamin I. Taul commissioner appointed by an Interlocutory
decree of the Montgomery Circuit Court in a suit in Chancery wherein Bennett
Clark is Complainant and Christopher Clark, Micajah Clark, Bowling Clark,
William Clark, James Clark, Jeremiah Rogers and Fanny his wife, Joseph Combs and
Susannah his wife, John Campbell and Judith his wife, Stephen Trigg and
Elizabeth his wife, Edward Bullock and Hannah his wife, William Winn and Polly
his wife, Thomas Pickett and Susan his wife. Ann B. Neally, Willis Collins and
Polly his wife, Mordicai Gist and Patsy his wife, Robert Clark and Patterson B.
Clark are Defendants of the one part and Andrew Lackey of the County of Estill
of the other part. Witnesseth that
the said Benjamin I Taul, Commissioner as aforesaid in consideration of the sum
of forty dollars to him in hand paid the accept where of is hereby acknowledged
hath granted bargained and sold to the said Andrew Lacky (he being the highest
bidder in ninety two acres of land situate lying and being in the County of
Estill Joining the Land of the said Andrew Lackey on the South side of the late
Robert Clark Senior, Deceased, and is bounded as followeth towit, Beginning at
the white oak and dogwood standing on the bank of the Kentucky River and comes
with the said Andrew Lackey and extending thence East thirty eight poles to two
sugar trees thence South Eighteen poles to a white oak and sugar tree thence
with Stephen line South forty nine degrees East one hundred and twenty six poles
to a white oak and dogwood corner to said Stephens thence North sixty seven
degrees East sixty poles, to a black walnut and a sugar tree on a small branch
comes to Boling Clark thence with said Clarks line bending on said branch North
eighteen degrees east thirty poles North thirty poles north thirty three degrees
west ninety four poles to four sugar trees at the mouth of said branch comes to
said Boling Clark thence down the river and bending thereon one hundred and
sixty poles to the beginning, together with the appurtenances thereunto
belonging. To have and to hold the
Land hereby conveyed with the appurtenances to the said Andrew Lackey and his
heirs to the only proper use and ______of him the said Andrew Lackey and his
heirs forever. And the said
Benjamin I. Taul, Commissioner as aforesaid the said tract or parcel of land

the said Andrew Lackey and his
heirs or assigns against the claim of all person claiming by through or under
the heirs of Robert Clark Senr. Deceased as far as directed by the Interlocutory
decree aforesaid and no further doth and wills warrant and forever defend but
not against any other person or persons for the said Benjamin I Taul
Commissioner or as aforesaid sells and the said Andrew Lackey buys only the
title of Robert Clark Senior to the said tract or parcel of Land and the heirs
of Robert Clark Senior or said Taul is to be no way liable or accountable either
for purchase money interest cost or damages provided the said land or any part
thereof should be lost. In Witness
whereof the said Benjamin I. Taul Commissioner as a foresaid saith hereunto set
his hand and affixed his seal this day and year first above written.

I Robt. Clark Clerk of the
Court for the County aforesaid do hereby certify that this deed from Benjamin I
Taul Commissioner to Andrew Lackey was proven by the Oaths of John Oldham and
Hezekiah Bauman, two of the subscribing witnesses thereto on the 21st
day of November 1825 before Abner W. Quinn, Clerk of the said County Court to be
the act and deed of the said Taul Commissioner is for the purposes therein
mentioned, as per certificate of said Quinn on Deed and therefore the same was
duly recorded in any office given under my hand this 8th day of March
1926

--Looks like Edward & Hanna Bullock were husband and wife.
It doesn’t tell why the master comm. had to sell the property or there
connection to Robert Clark.
--Robert Clark is who the mortgage was with.
(Robert Clark was the Clerk of Estill Co. at this time.
I don’t believe they are the same person.)
--I have enclosed two copies from a book in our office on the history of
Estill Co. Maybe this will help you
in deciding where to look next.
-The marriage information deals with Catharine Bullock. No new names.
