Deed Indenture of Elijah Bowman and John Williams

This indenture made this______1818 between Elijah Bowman and Elizabeth his wife of the county of Clay and commonwealth of Kentucky of the one part and John Williams of the county of Madison and State aforesaid of the other part witnesseth that the said Elijah Bowman and Elizabeth his wife for and is in consideration of the sum of 12 pounds current money of Kentucky. In hand paid to the said Elijah Bowman before the ensealing and delivery of these presents by the said John Williams, the receipt whereof I do hereby acknowledge and every part thereof and I do by these presents the said William acquit and forever discharge both given granted bargained and sold unto the said John Williams and his heirs forever one certain tract or parcel of land containing nine acres one quarters and 20 poles by survey bearing date the 30th day of June one thousand seven hundred and ninety seven lying and being in Madison County on the waters of Muddy Creek Kings branch adjourning James Barbours settlement on the west and Roberts Flemings on the east, and a survey of Sherlays on the North and bounds as followeth (towit). Beginning at the northeast corner of said Sherlay's Survey of 569 acres, a red oak tree marked M.S. standing in Barber's settlement line on King's branch running from thence with Barbers line north 100 poles passing his northwest corner to a small dogwood bush and three west 18 poles to a hickory tree in Flemings line thence= with Flemings line south 3 east 100 poles crossing Kings branch to a stake in said line on the south bank of said branch in Sherlay's line thence East with said line 12 poles crossing the aforesaid branch to the beginning with all and singular the right and privileges to the same belonging or in any wise appertaining to him the said John Williams and his heirs and assign as a clear undisputable estate in fee simple absolute to all intents and purposes as can be held or enjoyed by the said John Williams and the said Elijah Bowman that I will warrant claims whatsoever to the only use of him and the said Williams and his heirs. In witness whereof said Elijah Bowman and Elizabeth have set their hands and seals the day and date above written signed, sealed and delivered in presence of

Personally appeared before us Thomas Clarke and Elisha W. Bowman acting Justices of the peace for Clay County. Elihah and Elizabeth Bowman she being examined apart from her husband did both acknowledge the above their voluntary act and deed given under our hands this 12th day of September 1818 (signed Thos. Clarke and E.W. Bowman, State of Kentucky, Madison County.

I William Irvine Clerk of the court for the county aforesaid do hereby certify that this deed was this day produced to me in my office and acknowledged by Elijah Bowman to be his act and deed together with the certificate thereon and by virtue of said acknowledgement and certificate the same has been duly recorded in my office.

BIOGRAPHY OF WILBURN BOWMAN
Wilburn Bowman son of Elisha W. Bowman and Evaline Isaacs was born November 23, 1836 in Estill Co. Ky., later Owsley Co. Ky. Nothing is known about his childhood except he grew to manhood on his father farm until August 19, 1861 when he enlisted as a Private in Company A of the 7th Ky. Vol. Inf. at Booneville Ky., for a period of three years. He was described a being six feet tall, light complexion, blue eyes and light hair. He entered the service on September 22, 1861 at Camp Dick Robinson Ky. he saw action at Richmond Ky. on August 30, 1862, where he was listed as wounded in the thigh. He was reported in action from May 16, 1863 through May 23, 1863 at Vicksburg Ms., where a report of a wound in the left thigh was filed on May 22, 1863. He was honorably discharged as a Corporal at Louisville Ky. on October 5, 1864.
He married Mary Elizabeth McPherson in Clark Co. Ky. on January 30, 1866 and subsequently fathered the following children, John Bowman November 24, 1866, Fannie Bowman November 19, 1868, Jesse Bowman November 14, 1870, William Bowman October 17, 1872, Charlie Bowman October 13, 1874, Martha Bowman January 6, 1877, Rachel October 14, 1884. His first wife Mary died after 1898 and he married his 2nd wife Catherine ???, July 16, 1906.
Pension application number 258,782 dated May 21, 1881 is on file, plus a second application dated April 22, 1998, and a third application on May 24, 1912 all at Booneville Ky.
Wilburn passed away on march 15, 1917 in Owsley Co. Ky. His 2nd wife Catherine filed for a widows pension on April 18, 1917 at Owsley Co. Ky.
His 2nd wife Catherine stated that he was incapacitated for three months prior to his death requiring constant care that forced her to sell many of her household items to defray the cost of his care, since his death had left her destitute and without any means of support.


BIOGRAPHY OF EILHU BOWMAN
Elihu Bowman son of Henry B. Bowman and Rachel Plummer, was born February 21, 1842 at Proctor Estill Co. Ky., later Lee Co. Ky. Very little is known of Elihu until he enlisted in Company A 7th Ky. Vol. Inf. on August 19, 1861 at Booneville Ky for the period of three years. He was mustered into service on September 22, 1861 at Camp Dick Robinson Ky. He stated at enlistment that he was born February 21, 1842, height five foot and nine inches, complexion dark, eyes brown, hair black, occupation farmer.
Elihu reported for duty on September 22, 1861 at Booneville Ky., on October 21, 1861 he saw action at Camp Wildcat Ky., on December 27 thru 30, 1862 he saw action at Chickasaw Bluffs Ms., on January 10 thru 11, 1863 he saw action at Arkansas Post Ms., and again on July 9 thru 18, 1863 at Jackson Ms. . On September 5, 1863 he was reported on sick leave. On March 25, 1864 he reenlisted for a period of three years. On May 27, 1864 he suffered a sunstroke while on a march at Red River La. and was confined to the hospital boat on the Mississippi River. In July of 1864 he was transferred to Company C. 7th Ky. Inf., on August 17, 1864 he was on furlough. In December 1864 he was transferred from Co. C. to Co. D. 7th Ky. Inf., then on May 1 1865 he was promoted to Corporal in Co. D., and remained in this assignment until May 11, 1866 at which time he was honorable discharged at Baton Rouge La.
On September 12, 1864 he married Mary Jane Woodward the daughter of Martin Woodwood and Louisa Marcum at the home of the bride in Owsley Co. Ky. He subsequently fathered six children, ie: Louellen Bowman March 25, 1867, Martha Ann Bowman (twin) September 20, 1869, Mary Ann Bowman (twin) September 20, 1869, Florence Bowman February 24, 1872, and twins Stephen & Dugaled April 7, 1879 who died shortly after birth.
Elihu died on January 16, 1926, and Mary Jane died two years later on January 18, 1928.
Of the four daughters who survived, Louellen married William (Billy) Hogan, Martha Ann married (1) William Kilburn, (2) James Breckenridge Combs, Mary Ann married Charles Wesley Combs, and Florence (No data).

The plaintiffs Willis Hisle, Statutory Guardian for Edith Hisle, Mary Hisle, Simpson Hisle and Frances Hisle, infants under the age of 21 years, and B.T. Crouch, Statutory Guardian for Benjamin Webber an infant under the age of 21 years, and said infants by their said Statutory Guardian respectively state that on the 22nd. day of February 1856 one Jones Webber so departed this life in Estill County, and left the defendant Sarah Webber his wife and widow, and the infant plaintiffs and the following defendants his heirs at law: to-wit: William Webb and his wife Edith Webb, formerly Edith Webber; John Finnell and his wife Susan Finnell, former Susan Webber; hezekiah Bowman and his wife Elizabeth Bowman, formerly Elizabeth Webber, Sanford Webber, Jones Webber Jr.; Isaac Baker and his wife Naoma Baker, formerly Naoma Webber; Fountain Finnell and his wife Polly Finnell, formerly Polly Webber. (The five latter are now residents of the State of kentucky) Phillip Webber who is dead and left the following as his only heirs at law: to-wit: Augustin Webber, William Webber, Manerva Wood, formerly Manerva Webber who intermarried with the defendant James Wood, Absolam Webber, Edith Webber, Jones Webber, Martha Webber and Thomas Webber, the four latter are infants under the age of 21 years.

The plaintiff Willis Hisle states that he intermarried with Sarilda Webber, one of the children of said Jones Webber deceased, and that she is dead and left the following children and heirs at law: to-wit: Edith Hisle, mary Hisle, Simpson Hisle, and Frances Hisle. that each of said children are infants under the age of 21 years. He was appointed their statutory guardian and has taken the oath and given bond for the faithful performances of his duties.

The plaintiff B.G. Crouch states that one Simpson Webber was also a child and heir of said Jones Webber deceased, and that said Simpson Webber departed this life and left the infant plaintiff Benjamin Webber, his only child and heir at law, and that at the? term of the Oldham county Court this plaintiff was duly appointed statutory guardian for said Benjamin Webber. The plaintiff further state the said Jones Webber Sr. deceased at the time of his death was the owner in fee simple and in the possession of about ? acres of land in Estill County on the waters of the Kentucky River, whereupon the said Webber resided at the time of his death, which tract of land is worth about $2,000 and as said Webber had ten children or representatives, each child's part is worth about $200. They state that the defendant Sarah Webber, the widow of said decedent, is entitled to dower in said tract of land, that the same has never been assigned or allotted to her. that it is to the interest of the widow and the heirs that her dower in said land should be allotted to her, and for the purpose of effecting said allotment, and that a summons issued against all the defendants to this petition and that the court appointed commissioners for that purpose according to the provisions of the law in such cases.

JACOB BOWMAN WILL 1826

In the name of God Amen.
I, Jacob Bowman of the County of Clay and the state of Kent                       ucky, Being of and possessing a disposing mind and memory do ordain appoint and constitue this my last will and testament. To Wit.
1st it is my will that all my perishable property of every kind (after my debts are paid) remain on my farm for the sole purpose for raising my children and for the purpose of my wife during her widowhood and that my farm and the proceeds of all my land be used go to the raising of my children and support of my wife.
2nd Tis my will that when my youngest child comes of age that all my land be sold and the proceeds therof be equally divided among all my children reserving the one third of my land and proceeds thereof to my wife Elmore Bowman if she then be alive - I do hereby appoint my truly and faithful friend and Brother Elisha W. Bowman the sole executor of this my last will and testament.
In testimony where of I have unto set my hand and seal this thirtieth day of July in the year of our Lord on thousand eight hundred twenty six. Done in the presence of us-

Know all men by these presents that we Elner Bowman, widow of Jacob Bowman (descd) William Clark and Elijah Isaacs acknowledge themselves indebted to the Commonwealth of Kentucky in the sum of $500.00 which payment will truly be made. We bind ourselves, our heirs &c jointly and severally firmly by these presents. Sealed with our seals and dated this 25th day of November 1833.
The condition of the above obligation is such that if the said Elner Bowman, Administrator, with the will annex of the said Jacob Bowman, descd, shall well and good administer the goods and chattels of the said Jacob Bowman deceased do make a true and perfect inventory of all goods, chattels and credits of the said deceased which has or shall come to the hands, possession of any other person or persons for her and the same so make does exhibit into Court at such time as she shall be thereto required by the said Court, and the same goods and chattels do well and truly administer according to law and make a just and true account of all her actings and doings and faithfully execute said decendents Will and render an account when thereto required by said Court. And further do well and truly pay and deliver all legacies contained and specified in said will as far as the said goods, chattels, rights and credits will extend according to the value there of and as the law shall charge her, else remain in full force.
